Aaron Silberman Quoted by Law360 on Federal Rulings Vacating Wind Farm Stop Work Orders
Rogers Joseph O’Donnell P.C. shareholder Aaron P. Silberman was quoted in a recent Law360 article covering the lifting of stop-work orders by three federal judges for East Coast off-shore wind farm projects, including the Coastal Virginia Offshore Wind project.
The article focuses on the federal district courts’ disagreements with the Trump administration’s position that construction of these wind projects should be halted for national security reasons.
Silberman, co-chair of RJO’s Construction Law Practice Group, provided his perspective on U.S. District Judge Jamar K. Walker’s ruling to enjoin the stoppage of the Coastal Virginia Offshore Wind project after determining there were inconsistencies between U.S. Department of Defense statements and classified information it submitted to the court.
Silberman told Law360 that the court’s opinion essentially stated that “Deferring to the government is different than accepting what it says if it speaks out of both sides of its mouth.” He further noted that “It is so unusual for any administration to invoke national security and be shut down by a court. That is an incredibly low bar, and yet, they didn’t clear it.”
