Gregory Rosen Analyzes D.C. Circuit Ruling on Omnibus Nondisclosure Orders for Law360
Rogers Joseph O’Donnell PC shareholder Gregory P. Rosen authored an article for Law360 examining the U.S. Court of Appeals for the D.C. Circuit’s recent decision in In re: Sealed Case. The ruling curtails the government’s ability to rely on broad, forward-looking nondisclosure orders, known as omnibus NDOs, without specific judicial findings.
In his article, “D.C. Circ. Ruling Augurs More Scrutiny Of Blanket Gag Orders,” Rosen explains how the decision reinforces judicial oversight in the use of omnibus NDOs, which have often been employed by prosecutors to protect large volumes of investigative data. He outlines the implications for both the government and private entities, noting that the ruling “is a reminder that secrecy must be earned, not assumed.”
