Rogers Joseph O’Donnell PC shareholder Stephen Bacon shared his perspective in a recent Law360 article covering the U.S. Small Business Administration’s recent decision to initiate termination proceedings against 154 businesses in its 8(a) contracting program for exceeding income caps, statutory net worth or total asset limits. 

Bacon told Law360 that firms have an opportunity to challenge the agency’s noncompliance finding before the 30-day response deadline. 

“It’s not necessarily always the case that whatever financial information is reported is necessarily all the information that has to be counted in terms of looking at whether a firm exceeds the thresholds under the program or not,” Bacon told Law360. “And so there may be mistakes. There may be errors. There may be just differences of opinion regarding how certain assets are valued.” 

Bacon regularly advises government contractors on 8(a) compliance and represents them in disputes before the U.S. Court of Federal Claims, the Government Accountability Office, the Boards of Contract Appeals, and the Small Business Administration’s Office of Hearings and Appeals.
