Rogers Joseph O’Donnell PC shareholders Lauren Kramer Sujeeth and Gregory P. Rosen published a Law360 article that covers the implications of a recent D.C. Circuit ruling for the limits on nondisclosure orders in In re: Sealed Case.

As a follow-up of Rosen’s recent Law360 article on an earlier D.C. Circuit decision on omnibus nondisclosure orders, Sujeeth and Rosen examine the growing tension between transparency and secrecy in digital-era enforcement investigations, and how the court’s recent decisions are refining the rules governing nondisclosure orders and sealed filings tied to grand jury proceedings.

Sujeeth and Rosen also provide advice for technology companies, investigative targets, and transparency watchdog organizations and emphasize the importance of challenging nondisclosure orders in real time, as later attempts to unseal records face steep legal barriers.

Sujeeth is chair of RJO’s White-Collar Criminal Defense practice group and represents companies and individuals facing regulatory investigations or state and federal criminal charges, focusing on public corruption, fraud and cryptocurrency claims.

Rosen is a member of RJO’s White-Collar Criminal Defense and Government Contracts practice groups. He provides counsel in civil and criminal enforcement matters, internal investigations, debarment actions, Title IX hearings, and complex disputes.
