Law360 Quotes Jon-Erik Magnus in Article on Food and Beverage Cases to Watch in 2025

Rogers Joseph O’Donnell PC shareholder Jon-Erik W. Magnus shared his insights on Extended Producer Responsibility (EPR) laws with Law360 for an article about upcoming food and beverage cases lawyers will be watching in 2025. 

Magnus, quoted in the article (subscription required) “Food & Beverage Cases to Watch in 2025,” told Law360 that companies whose products use single-use packaging must be prepared to follow new EPR laws in several states that hold producers responsible for the entirety of the product packaging’s lifecycle. 

This is the first time EPR laws are being applied to single-use packaging. Compliance requirements include mandatory reporting to the producer responsibility organization (PRO) chosen by each state with an ERP law to oversee implementation. Oregon, which has the first reporting deadline of any state on March 31, will be the bellwether case for “how producers are going to report, how easy it will be to report, and how well the [PRO] will be able to handle the flood of data.” 

Magnus told Law360 that each state will have different EPR requirements, and there is no one-size-fits-all approach. He urged manufacturers to begin gathering their data now so they do not fall behind on reporting requirements. 

“This is the first time we’re doing this kind of reporting for these kinds of packaging products for any of these EPR laws,” Magnus told Law360. “I think it’ll be very telling for these companies to go through this and learn how they can do better.”
