National Media Interviews Greg Rosen about DOJ’s Criminal Information Filing on James Comey

Several national news outlets reached out to Rogers Joseph O’Donnell PC shareholder Gregory P. Rosen for his perspective on the Department of Justice’s latest filing against former FBI director James Comey.

The coverage, including CBS News, NBC News and Straight Arrow, focuses on federal prosecutors’ third attempt to bring criminal charges against Comey. This time, charging Comey with transmission of national defense information and conspiracy to transmit national defense information. His defense attorneys argue the charges should be tossed out because of statute-of-limitations issues. The DOJ claims that filing a criminal information, a formal written accusation reflecting the prosecutor’s decision to charge, in order to pause the statute of limitations is a “widely recognized practice.”

Based on his experience as a former supervisor in the U.S. Attorney’s Office for the District of Columbia, Rosen told Straight Arrow that the term “‘widely recognized’ is doing a lot of heavy lifting” in the DOJ’s claim. Rosen commented to NBC News, “Filing a placeholder charge the defendant can’t be tried on, on the last possible day, under seal, in the third case against the same man, is not routine or ‘widely recognized.’”

A member of RJO’s White-Collar Criminal Defense and Government Contracts Practice Groups, Rosen represents clients in criminal and regulatory matters involving the False Claims Act, particularly in the field of government contracts, procurement and federal fund recipient fraud. He also handles high-stakes financial and regulatory investigations, among other matters.
