RJO Helps MOX Services Secure $21.6 Million Summary Judgment Award

On behalf of CB&I AREVA MOX Services, LLC (MOX Services), the RJO Government Contracts Group obtained a $21.6 million summary judgment award in a U.S. Court of Federal Claims case against the United States, acting through the National Nuclear Security Administration (NNSA). Determining that the controlling contract entitled MOX Services to retain previously paid fee until construction of the mixed oxide fuel fabrication facility was completed, on June 11, 2018, Judge Thomas C. Wheeler ordered the government to refund to MOX Services $21.6 million in fee that NNSA had prematurely clawed back from the contractor. RJO attorneys representing MOX Services on the motion included Mark J. Linderman, Dennis J. Callahan, and Stephen L. Bacon.
