Stephen Bacon Publishes Washington Technology Article on Recent SBA 8(a) Terminations
Stephen Bacon, a shareholder in Rogers Joseph O’Donnell’s Government Contracts Practice Group, published an article in Washington Technology on the U.S. Small Business Administration’s (SBA) recent decision to initiate termination proceedings against 154 businesses from its 8(a) contracting program for not meeting the program’s eligibility requirements for economic disadvantage.
Bacon writes that firms have 30 days to respond to the SBA and explain why their termination is unjustified. He adds that, given the broad scope of the SBA’s review, miscalculations are likely, and firms should ensure the agency’s analysis is accurate before the 30-day response window closes. Bacon also highlights several areas prone to miscalculation and outlines the process firms should follow to appeal.
Bacon regularly advises government contractors on 8(a) compliance and represents them in disputes before the U.S. Court of Federal Claims, the Government Accountability Office, the Boards of Contract Appeals and the SBA’s Office of Hearings and Appeals.
