Mr. Arbuthnot concentrates on resolving construction disputes, including changed conditions, extra work and delay claims, and other breach of contract issues. He has experience with bid protests, warranty and defect claims, and various design issues. His practice extends to pursuing and defending lien, stop notice, and bond claims. Mr. Arbuthnot has considerable experience with both public and private projects. His clients are prime contractors, subcontractors, owners, design professionals, and material suppliers. His representation includes commercial builders, roadway contractors, solar power companies, homeowners, engineers, electrical subcontractors, landscapers, and many others. He also negotiates and prepares a wide variety of construction and commercial contracts. He is a member of the Associated General Contractors of California – Legal Advisory Committee, and his duties include drafting and revising the AGC contract forms.
Mr. Arbuthnot also has experience with a wide array of other litigation issues that arise in the commercial context. He has a comprehensive background in all aspects of the civil litigation process, including jury trial experience. His practice encompasses disputes in a variety of industries, including real estate, technology, manufacturing, agriculture and retail, among others. His commercial litigation experience ranges from shareholder actions against technology companies to breach of contract claims between international art galleries.
Mr. Arbuthnot was a full-time judicial extern for the Honorable Charles R. Breyer of the Northern District of California during his final semester of law school. His duties consisted of analyzing various complex constitutional and federal issues, such as illegal banking practices under the Truth-in-Lending Act, and drafting Decision & Order Memoranda on motions and writs pending before the court.
