Three days into a multi-week trial, RJO attorneys Dennis Huie, Sharon Rossi and Katherine Svinarich, representing a franchisee of a national fast food restaurant chain and its management company, secured favorable trial court rulings in a Private Attorney Generals Act case where the Court ruled that PAGA penalties were capped at less than .03% of the penalty sought by Plaintiffs.
The case involved novel questions of law based on alleged violations of Labor Code section 1391 (which restricts work hours for certain employees under the age of 18). The class of purportedly aggrieved employees consisted of more than 270 current and former employees who worked at 22 franchised restaurants.
The rulings resulted in a very favorable settlement for RJO’s client eliminating the need to defend a costly anticipated appeal from Plaintiffs of the trial court’s decision.
